As with all Terms and Conditions, they are quite long and wordy but it is important that you read them and understand their impact and any consequences on your use of the the Site. By entering the Site, shopping, browsing or otherwise using this Site, you agree to abide by these Terms and Conditions . Arbol Crafts may at any time amend these Terms and Conditions by updating this section of the Site - so do please check back regularly. By using the Site after we post changes to the Terms and Conditions, you agree to accept those changes, whether or not you have actually reviewed them.

MANUFACTURERS & SUPPLIERS

This Site contains products sourced from a variety of different Manufacturers and Suppliers. Where these are relevant to the listed product, they are included in the product description. For the "Die Cuts" category of the Site, the Manufacturer's name refers to the Manufacturer of the die with which the shapes were cut. It does not, in any way, suggest that the Manufacturers have actually cut the shapes on offer.

TRADEMARKS, COPYRIGHTS & RESTRICTIONS.

This Site contains registered trademarks and images that are the intellectual property of other companies. These include, but are not limited to, Ellison Design, Sizzix, Accucut, Crosscuts and Quickutz. Text, images, brand names and trademarks remain the property of those companies. All material on the Site, including, but not limited to, images, illustrations, designs, photographs, descriptions, writings and posts (the "Materials") are copyrights, trademarks or other intellectual property owned, controlled or licensed by Arbol Crafts or, in the case of Manufacturers and Suppliers, by their respective owners.

Permission is hereby granted to display, copy, download and print portions of this Site for the purposes of placing an order with Arbol Crafts or promoting the Site to other users. With the exception of Materials owned, contolled or licences by Manufacturers and Suppliers, you may also use the Materials on the Site for your own private purposes (for example, to make cards for your personal use). However, you may not sell, display, copy, create derivative works from or use for any other commercial purpose including, but not limited to, distribution or sale to third parties, the Materials on this Site without the prior written permission of Arbol Crafts. Any modifications of the Materials, or any portion thereof, or use of the Materials for any other purpose constitutes an infringement of the Arbol Crafts's copyrights and other proprietary rights. Please be original with your commercial designs!

Arbol Crafts is not responsible for the content of any sites that may be linked to or from the Site, or any bulletin board associated with the Site. These links are provided for your convenience only and you access them at your own risk. In addition, a link to any other web site does not imply that Arbol Crafts endorses or accepts any responsibility for the content or use of such other web site. No reference to any third party or third party product or service shall be construed as an approval or endorsement by Arbol Crafts of that third party and / or its products or services.

Arbol Crafts is committed to protecting the security and confidentiality of all personal data collected or otherwise processed through the Site. PRODUCT INFORMATION

Prices and availability information shown on the Site may change at any time without prior notice. Product stock quantities are provided for information purposes only and do not constitute a guarantee of available stock. Any Recommneded Retail Prices ("RRP") relate to the Manufacturer's suggested selling prices and may not be indicative of the actual selling prices in your area. Any reference to "Savings" or "Sales" used on this Site refer either to a saving from the RRP or a reduction in its normal Site listing price.

Export shipping costs are calculated on the basis of the total weight of your order. They are calculated on a DDU (Delivered Duty Unpaid) basis and do NOT include any import or customs duty which may be payable in your own country. You are soley responsible for any customs clearance, duty payments or other regulatory requirements in your own country.

We try to describe and display all products shown on the Site as accurately as possible. However, because of the technical differences in the equipment of our customers, we cannot be responsible for photographic differences in size, shape and colour of the products.

The receipt of an email order confirmation is simply a recognition that we have received your requested order, and does not constitute an offer to sell or an acceptance of your offer to purchase any such products. We reserve the right to limit sales, by quantity and / or by customer, without having to give an explanation.

DISCLAIMERS AND INDEMNITY

By using the Site you agree to indemnify the officers, directors and employees of Arbol Crafts for any and all claims, damages, losses, liabilities and causes of action (including legal expenses) arising from or relating to your breach or alleged breach of these Terms and Conditions (including without limitation, claims made by third parties for infringement of intellectual property rights). Arbol Crafts is not liable nor responsible for the content including the accuracy, integrity, quality or reliability of any such facts, views, opinions, statements and recommendations. You rely on them at your own risk.

The Materials on this Site are displayed, transmitted and distributed "As Is" and appear on the Site without express or implied warranties, conditions, terms or representations of any kind including, but not limited to, product quality or fitness for a particular purpose.

LIMITATION OF LIABILITY

Neither Arbol Crafts, nor its officers, directors and employees are responsible for any special, incidental, indirect or consequential loss or damages or any loss of data, profits, income, goodwill, contracts, or any other loss or damage whatsoever arising out of or in connections with the use of, or the inability to use, this Site and / or the Materials on this Site.

TERMINATION

Arbol Crafts may, in its sole discretion, terminate or suspend your access to all or part of the Site, including, but not limited to, any message boards on the Site, for any reason, including without limitation, breach of these Terms and Conditions. If you breach these Terms and Conditions, your authorisation to use the Site and any permissions previously granted automatically terminate and you must immediately destroy any downloaded or printed materials and content. Arbol Crafts retains the right to refuse any and all current or future use of or access to the Site.

JURISDICTION

The owners of Arbol Crafts operate the Site from its offices within the United Kingdom. We make no representations that Materials on the Site are legal or appropriate for use outside the United Kingdom . If you choose to access the Site from other locations, you do so at your own risk and are responsible for compliance with any and all local laws.

This Agreement will be governed by and construed in accordance with English law. You irrevocably submit to the exclusive jurisdiction of the English courts in respect of any claims brought to enforce these Terms and Conditions or matters related to the Site.

GENERAL

If any provision of these Terms and Conditions is deemed void, unlawful, or otherwise unenforceable for any reason, that provision will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will remain in force. Failure by Company to exercise or enforce any right conferred by these Terms and Conditions shall not be deemed to be a waiver of any such right, nor operate so as to bar the exercise or enforcement of such right or any other right on a later occasion. These Terms and Conditions constitute the entire agreement between you and the Company concerning your use of the Site, and the Agreement will not be modified without the written consent of a director of Company. You may not assign these Terms and Conditions nor any of its rights or obligations under these Terms and Conditions. The Contract (Rights of Third Parties) Act shall not apply to these Terms and Conditions.

We welcome your feedback about the Site and any design suggestions you might like to sumbit.
